Utilisation of content from the WPK website using text mining and data mining

The WPK makes the publicly accessible content on its website www.wpk.de available for automated analysis (text mining and data mining), but asks that the legal requirements be strictly observed:

Copyright protection

  • Laws, ordinances, official decrees and announcements as well as decisions and official guidelines for decisions reproduced on the website are not protected by copyright (Section 5 (1) UrhG).
  • Other contents of the website are protected by copyright, but can be used in principle. The content may not be changed in a way that distorts or falsifies the original meaning (Section 5 (2) in conjunction with Section 62 (1) to (3) UrhG). In particular, the content may not be used in a context that portrays the WPK or its activities in a false or misleading light.

Data protection

  • The use of AI and data mining technologies on the WPK website must not lead to the processing of personal data in contravention of the GDPR or other data protection legislation. In particular, the data subject rights listed in the WPK's privacy policy (in German) must also be guaranteed by users, including Right of access (Art. 15 GDPR, Section 34 BDSG), right to rectification (Art. 16 GDPR), right to erasure or right to blocking (Art. 17 GDPR, Section 35 (1) and (3) BDSG), right to restriction of processing (Art. 18 GDPR, Section 35 (2) BDSG), right to data portability (Art. 20 GDPR) and right to object (Art. 21 GDPR, Section 36 BDSG).
  • Users who operate AI systems that are intended for direct interaction with natural persons are themselves responsible for complying with the statutory transparency obligations (Art. 50 EU GDPR).

Disclaimer of liability

The WPK accepts no liability for the accuracy, completeness or currency of the content provided. Mandatory statutory liability provisions remain unaffected.

Implied consent

By using the contents of the WPK website, users declare their agreement with these notes and undertake to comply with them. The WPK reserves the right to take legal action against any unauthorised use of which it becomes aware (Sections 97 ff., 106 ff. UrhG). This includes the right to declare reservations of use (Section 44b (3) UrhG) in the future.
